Soipan Tuya Sues Estranged Husband for KSh 425k Child Support

Environment CS Soipan Tuya has gone to court seeking custody of their two children and KSh 425,000 for upkeep.

Tuya also claims her estranged husband, Stephen Kudate, treats their children and domestic workers with cruelty.

In documents filed at the Nairobi Children’s Court, the CS accuses Kudate of being psychologically, emotionally, and verbally abusive towards her, the children, and the domestic workers.

It is on those grounds that she is seeking custody of the minors.

“Owing to his abusive and erratic nature, we have been living in mortal fear for our lives,” she said.

The CS is also seeking an order compelling the husband to pay KSh 225,000, which is 50 percent of the children’s KSh 450,000 school fees.

She is also seeking Kudate to pay KSh 100,000, which is 50 percent of the KSh 200,000 children’s monthly entertainment needs.

She further wants the court to compel her estranged husband to pay KSh100,000, which is 50 percent of KSh200,000, for the two children’s maintenance.

Court documents say the two lived together until December 2, 2013. They were in a relationship until December 2020, when they separated.


According to CS Tuya, Kudate moved out of her house to go and live with his other wife.

She further claims that the husband has yet to file any response, despite her having served him with the court papers in July.

She further claims her estranged husband has continued to fail to play his part and only issues her threats.

The CS wants the matter certified as ready for hearing because of the inordinate delay by her estranged lover in entering an appearance or filing his response.

Tuya claims the husband is a legitimate threat to her well-being and that of her children and domestic workers.

“Despite the complaint being served upon him on September 1 and the acknowledgement of receipt, he has not filed nor served me with any documents nor entered an appearance to that effect,” she said.

“In December last year, he insulted me in a text message denying paternity of the two minors, demanding a DNA test to ascertain his biological connection to the children,” she claims.

She claims her estranged husband has constantly and frequently displayed a violent and uncaring attitude towards her since 2014.

“He committed untold physical, emotional, and psychological harm to the children and me. He severely intimidated my domestic staff, even sexually and physically threatening them on several occasions,” the court papers read.
