Felix Odhiambo Orinda, alias DJ Evolve has applied to have an ongoing court case against Embakasi East MP Babu Owino withdrawn.
Through his lawyer Kenneth Mumbo, DJ Evolve noted that they held deliberations as a family and decided to withdraw the case so that he can concentrate on his treatment.

In the letter dated September 21, 2020, the lawyer added that the pending case is affecting the DJ’s healing process due to divided attention.
“The family had been on an intense deliberation on a need to allow the complainant, Orinda to concentrate on his treatment rather than the pending case which was affecting his healing process due to divided attention,” Mumbo said.
However, Director of Public Prosecution (ODPP) Noordin Haji rejected the request citing more time to give a comprehensive response.
Through Joseph Irungu, the DPP added that they also have to establish the motivation and reason behind the family’s decision to withdraw the case.
To achieve this, DPP Haji insisted that it was crucial they engaged DJ Evolve.
Owino was charged with attempted murder of DJ Evolve following a shooting at Nairobi’s B-club on January 16, 2020.
A police report on the incident details DJ Evolve got into an argument with Owino at the club before the shooting happened at about 7 am.
In a CCTV footage, Owino is seen surrounded by other revelers when the DJ falls from the impact of the bullet.

The MP and his assistant then quickly rushed the injured entertainer to the Nairobi Hospital where he was admitted in critical condition.
