Woman Charged in KSh100 Million Mombasa Land Fraud Case

Farzana Nur Butt

A Mombasa court has charged Farzana Nur Butt over an alleged scheme to grab two prime parcels in Likoni, with the disputed property valued at KSh100 million.

A woman has been charged with allegedly conspiring to defraud a landowner of two Mombasa properties worth KSh100 million in a case involving disputed title records and alleged forcible entry.

Farzana Nur Butt appeared before Senior Resident Magistrate Gladys Olimo, where she denied three charges linked to the disputed parcels.

The properties, registered under LR Nos. Mombasa/MS/Block 1/1944 and Mombasa/MS/Block 1/1945, belong to Susan Wanjiru Kangethe.

Prosecutors allege that Butt conspired with other people who have not been brought before the court to deprive Kangethe of the properties.

The alleged conspiracy dates back to July 12, 2006, and reportedly continued until October 20, 2026.

Disputed Titles

In the first count, Butt faces a charge of conspiracy to defraud, contrary to Section 317 of the Penal Code.

The prosecution alleges that the two parcels were claimed without the registered owner’s authority.

The court also heard allegations that Butt’s relatives, Jamshed Ahmed Butt and Fahmeda Begum Butt, registered the properties in their names.

Prosecutors allege that Butt knew the registration was based on false information.

She also faces a second charge of obtaining registration of land by false pretences, contrary to Section 320 of the Penal Code.

According to the charge, Butt allegedly inserted Title Lease No. Mombasa/MS/Block 1/416 into land records at the Mombasa Land Registry on July 12, 2006.

The prosecution alleges that the lease was inserted to deprive Kangethe of the two properties in Shelly Beach, Likoni.

Investigators will have to establish the alleged falsification and the accused’s role in the disputed land records during the proceedings.

Alleged Entry

Butt faces a third charge of forcible entry, contrary to Section 90 of the Penal Code.

Prosecutors allege that she entered the premises in Shelly Beach, Likoni, without the registered owner’s authority.

The alleged offence reportedly occurred on diverse dates between July 9, 2025, and October 20, 2026.

The prosecution claims the entry was intended to annoy the registered owner.

Butt denied all three charges when she appeared before the court.

The allegations remain unproven, and the accused is presumed innocent unless proved guilty.

KSh1 Million Bond

Through her lawyer, Butt asked the court to release her on reasonable bond terms.

Her defence told the court that she had a fixed residence within the court’s jurisdiction.

Assistant Director of Public Prosecutions Breda Ogada, who prosecuted the case, urged the court to impose bond terms appropriate to the charges.

Magistrate Olimo granted Butt bond of KSh1 million, with a surety of a similar amount.

The court scheduled the pre-trial conference for November 12, 2026.

The proceedings will determine the prosecution’s evidence concerning the disputed titles, alleged fraud, and claims of forcible entry.
