The lawmaker was charged with attempted murder after he was accused of shooting the DJ on the neck in the Friday morning, January 17.
While pushing for his release on bail, the MP’s lawyer Cliff Ombeta challenged the prosecution’s plea to detain the lawmaker saying the legislator has been cooperative.
Ombeta said the accused is the one who took the victim to the hospital and cooperated when he was asked to hand over his weapon.
He further said the legislator was a family man who has a wife and two children.
“He’s a candidate for bail. He’s an MP who must go back to work,” said Ombeta.
Ombeta further dismissed prosecution’s claims that the MP could interfere with witnesses.
“Interfering with a witness is a criminal offence. The question is when did he do it and where?” he asked.
Ombeta also argued that since the MP had denied the charge, it was only prudent for the article 50 of the Constitution to apply, which accords him the presumption of innocence until proven guilty.
A Police report on the incident details DJ Evolve got into an argument with Owino at the club before the shooting happened at about 7 am.
