Blow for Charity Ngilu as petition challenging her impeachment is thrown out

A petition challenging Kitui Governor Charity Ngilu’s impeachment has been thrown out by the High Court, citing lack of merit.

According to Justice Weldon Korir, the application by Governor Ngilu has not met the threshold to warrant the grant of conservatory orders.

Korir also noted that the petition that temporarily stopped her impeachment, was filed in Nairobi and not Kitui County.

“Impeachment of a governor is a kin to an election petition. It would therefore be advisable that any person desirous of filing a court case in respect to an impeachment should approach a High Court within the county in which the impeachment is taking place,” Korir said.

The new development now means Kitui MCAs will proceed with Governor Ngilu’s impeachment as planned.

On June 25, Ngilu moved to court to seeking to stop her impeachment, the county boss argued that the planned impeachment denied her rights to a fair administrative action and fair hearing.

She also sued the County Assembly, the Speaker and the Clerk of the Assembly, who were listed as the first, second and third respondents respectively.

The MCAs are seeking to impeach Ngilu over gross violation of the Constitution and the County Governments Act by failing to honour summons of the Senate.
