Kirinyaga: Woman Sues Her 97-Year-Old Mother for Trespassing

A businesswoman from Kirinyaga County is embroiled in a heated court battle with her 97-year-old ailing mother.

According to Nation, Mary Nguru sued her mother, Sabena Wairimu for trespassing on a commercial building at Baricho market. 

Nguru also accused her mother of harassing her tenants and she now wants the court to restrain the latter. 

She argued that she is the rightful owner of the property which is at the center of the dispute, adding that she has been making prompt payments for necessities. 

They include paying for electricity and water and paying the required rates to the Kirinyaga County government.

In court papers, Nguru noted that her mother and her other six children trespassed the property and incited the tenants to stop paying rent. 

The accused persons are also said to have broke some locked toilets in the property. 

On the other side, Wairimu dismissed the claims arguing that she co-owns the property with her departed husband Cyprian Kimanjui. 

She argued that she has not transferred her shares to her daughter or any third party.

“I wish to reiterate that the suit property does not belong to the plaintiff and falls within the estate of my deceased husband, which estate is subject to the process of succession,” Wairimu argued. 

The case will be mentioned on May 11.
